No, not when the product is only available to one organization, which are the users of this forum, which is partly also why the kernel is requested to not be mirrored and doing so you violate the license agreement when installing it (see text in red).
However, if they do not redistribute the GPL'd program, they may still use the software within their organization however they like, and works (including programs) constructed by the use of the program are not required to be covered by this license.

But in essence I do agree that this is not really cool, and I didn't like such an approach, but since open source is used on xda to pinpoint people rather than to stimulate a group effort, and this is all seen as a big competition, I have been taught to reconsider my position as the GPL spirit is completely lost like this anyway.
If you don't want to be part of this, just let me know and I can disable your user account, as this for the time being is a "keep it or leave it" condition and I will not start debating on this.
If this all gets out of hands, the conclusion will be very simple, I'll just keep the kernel for myself and stop sharing it, since in case this got forgotten, that's how it all started, I used it and people started to ask me if they could have it and I didn't mind, but I quite easily could recnsider, with all the crap that has been going on lately, as my private free time can be used for other things very easily.
